THE STATUTE

OF THE "Freestyle Session Europe 2009" CONTEST

1. ORGANIZER AND GENERAL REGULATIONS

1.1 The following regulations shall define the rules of "Freestyle Session Europe 2009" Contest, called hereinafter the Contest.Poniższy Regulamin określa zasady przeprowadzenia konkursu "Freestyle Session Europe 2009" zwanego dalej Konkursem.

1.2. The Organizer of the Contest is Plej Entertejement Łukasz Ostaszewski, located at ul. Walecznych 56/1 in Warsaw, postal code 03-926, Poland, with the entry in the business activity register number 450006, with the taxpayer identification number 113-225-91-26, called hereinafter the Organizer. zwany dalej Organizatorem

1.2.The Sponsor of the prizes in the Contest is the Nowe Centrum Sp. z o. o., the owner of the Silesia City Center shopping mall, located in Katowice, at ul. Chorzowska 109a, entered into the register of entrepreneurs kept by the District Court for Katowice 0000060126, with the taxpayer identification number 634-23-10-451, called hereinafter the Sponsor.

1.3 The Contest will take place in Poland, in the Silesia City Center shopping mall at ul. Chorzowska 107, 40-101 Katowice, on the 16th and 17th of May, 2009.

2. PARTICIPANTS OF THE CONTEST

2.1 The Contest is open only to teams composed of persons residing in the territory of Europe (including Turkey). Minors must have written consent of their statutory agents (e.g.: parents, legal guardians) to participate in the Contest (see section 5.3 of the Statute). A form for providing this consent of constitutes Annex No. 1 of the present Statute.

2.2 The employees, family members and representatives of the Organizer, the Sponsor, companies: Plej Entertejment, SCC Management Sp. z o.o., and persons that take part in the arrangement and conducting of the Contest are ineligible to compete in the Contest.

3. PRINCIPLES OF THE CONTEST

3.1. Five-person male and female teams take part in the contest.

3.2 To take part in the Contest, complete a registration form for a team and a declaration that you will find at www.freestylesession.pl in the section REGISTRATION. Completed registration forms and declarations must be sent to rejestracja@freestylesession.pl.

3.2.1 In order to participate in the Contest, a payment of 60 PLN (for Polish teams) or 30 EUR (for international teams) must be made at the day of the event.

3.2.2 In the case of mixed teams, the majority rule will be obligatory: if more than 2 members of the team are inhabitants from abroad of Poland, then the payment of 30 EUR is required.

3.2.3 The payment must be made at the time of the team’s registration in the Contest Office. The Contest Office will be placed in the tent on the Plac Sloneczny in Silesia City Centre, at ul. Chorzowska 107, in Katowice.

3.2.4 Regardless of the online registration, after getting the email confirmation of team’s registration, participants are required to deliver to the place of the Contest:

a) Adults: a signed copy of a present Statute and signed declaration concerning the usage of the participant’s image (Annex No 2 of the present Statute);
b) Minors: written consent of the statutory agent for the participation in the Contest (Annex No 1) .

3.3 Participation in the Contest is determined by the order of online applications. Maximum 64 teams can participate in the Contest.

3.4 The Contest
a) 16th of May, 2009– registration and eliminations;
b) 17th of May, 2009 – finals and identifying the winning team.

3.4 Participants arrive at the Contest at their own expense. The Organizer and the Sponsor shall not provide accommodation, meals, nor reimbursement for the costs.

3.5 Minors must have a written permission from their statutory agent to participate in the Contest. The written permission is mentioned in the Statute in the section 2.1

3.6 Dancing competition conducted in the framework of the Contest will be played according to the social standards.

3.7 Contest Organizer is not responsible for any inability to make the entry or transmission of personal data for reasons beyond the control of the Organizer.

3.8 All participants take part voluntarily in the Contest, at their own expense and at their own risk. The Organizer is not liable nor responsible for injuries sustained during the event.

3.9 Detailed principles of the Contest:
1. Only teams that will send online registration form from 10th of April to 13th of May can participate in the Contest. Applications will not be accepted on the day of the Contest.
2. Battles will be judged by the special jury selected by the Organizer of the Contest of which all decisions related to the Contest are final.
3. In the first elimination phase battles will last about 6 min., in the next elimination phase 7 min., and in the final tournament 8 min.
4. On the first day of the Contest 64 teams will compete according in single-elimination tournament. The Jury will choose the best 16 teams, which will compete in the final tournament the next day, also in single-elimination tournament format.
5. A team that wins the Contest will be promoted to the World Finals of „Freestyle Session” in Los Angeles.
3.10 Detailed rules of participation:
1. The tournament is open only to teams composed of persons residing in the territory of Europe (including Turkey).
2. The team must be composed of exactly five b-boys/b-girls.
3. Organizer does not see a problem if a team is formed by combining teams with one another and this is completely allowed.
4. Each team is required to send their application via the Internet.
5. Each team is required to pay fee - 60 PLN for Polish teams and 30 EUR for foreign.
6. Payment of fee can be made at the Contest Office at the day of the event. 7. A maximum of 64 teams may participate in the tournament.

4. PRIZES IN THE CONTEST

4.1 The Sponsor of prizes is Nowe Centrum Sp. z o.o., ul. Chorzowska 109a, 40-101 Katowice – the owner of the Silesia City Center shopping mall.
4.2 The Contest will award the following prize:
Payment of travel (airline ticket) between any location in Europe and Los Angeles, California (United States) for the members of the winning team.

4.3 In order to apply for the award, teams must be eligible to compete in and pass the elimination stages.

4.4 No cash equivalent will be awarded in lieu of the prize.

4.5 The prize, in the form of a voucher, will be awarded by the Organizer of the Contest immediately following the final tournament.
The total tax associated with the above listed prizes and their regulation are the responsibility of the Organizer, which will pay the flat-rate tax for prizes.

5. CONSENT AND RIGHTS

5.1 Entrants agree to filming, photography, and the use of their image and to delegate to the Organizer copyrights and related rights to dispose of and use of all their performances and interviews carried out or provided in connection with the Contest and their audio and video recordings (all of the above elements hereinafter referred to collectively as the "Recordings"), including, in particular, to allow third parties to use the Recordings, in whole or in part worldwide in all media, without a time limit in all known fields of operation, in particular those in the article 50 of the Law on Copyright and Related Rights, including the right to and including their registration, consolidating and multiplying each technique, marketing, broadcasting and reediting in television, the use of the Internet and mobile networks, VOD.

The participants of the Contest agree to allow the Organizer, Nowe Centrum Sp. z o.o., 4fun TV, TV 4, Radio Planeta FM, fotka.pl, gadu-gadu, ipla.pl, cgm.pl and other cooperating companies to use their name, surname, voice, image and biographical facts they made accessible to 4fun TV and Radio Planeta FM during or in the relation with the Contest, and for commercial, marketing and promotional reasons of the Organizer and Nowe Centrum Sp. z o.o.

Participants acknowledge that the promotional value associated with the possible use of their image and performance in the Recordings in the affiliated sites 4FUN TV and Radio Planeta FM is a full and adequate compensation for participation in the implementation of Recordings and the transfer of rights and granting of approvals referred to above.

5.2 Participants in the Contest, by submitting to participate in the Contest, agree to their processing of personal data by the Organizer and Sponsor, and the transmission of information to third parties for the purposes of the Statute of the Contest, in accordance with the Law of 29 August 1997 on the protection of personal data (Dz. Laws of 1997, no. 133, item 883 with subsequent amendments). Providing personal data is voluntary. Participants have the right to inspect and correct personal information.
Participants of the Contest acknowledge that the Organizer will not be required to award the prize to a winner if they do not provide personal information required to award prizes and other activities defined by law. Personal data is considered to include: the first name, surname, address, series and number of an identity card (for adult participants), taxpayer identification number and the passport number in the case of winning the main prize. These data are erased at the end of the Contest.

5.3 In addition, the Organizer and the Sponsor reserve the right to select a different winner, or refuse to grant a prize to a Contest winner who, prior to the issuance of prizes (and in no case, later than within 7 days of receipt of notification of winning the Contest) have not transferred to Organizer those documents referred to in Section 3.2 of the Statute of the Contest.

6. FINAL REGULATIONS

6.1 The regulations of the present Statute shall be the sole basis for conducting the Contest and their interpretation is unique to the Organizer.

6.2 The present Statute is available for inspection in the premises of the Organizer, at the website www.freestylesession.pl and by postal mail by remitting a self-addressed stamped envelope.

6.3 The Organizer reserves the right to change the regulations of the Contest, including the regulations of this Statute during the Competition.

6.4 Any complaints about the Contest should be reported in writing to the office of the Organizer along with a detailed justification, on pain of expiry of any claim of a person in connection with the Contest, not later than 14 days from the date of completion of the Contest. Organizer shall decide on complaints about the Contest within 14 days from the date of lodging the complaint. The decision of the Organizer shall be final, conclusive, and no appeal will be granted.
